Small Claims Court

Small Claims Court handles matters up to $25,000.00, excluding interest and costs, such as court fees and legal representation fees. The Rules of the Small Claims Court provide certain processes and procedures which must be followed when commencing your action and enforcing same. Failure to understand the rules and procedures of the Small Claims Court may end up costing you time and money.


Ensure you understand the rules and guidelines of Small Claims Court, in addition to the legal principles that apply to your matter. Many cases fail because the right issues were not claimed and/or sufficient evidence was not presented and proper procedures not followed. This may be the deciding factor of the outcome of your case.

If you are a Defendant to a Plaintiff’s Claim, you must respond by way of a Defence and supporting evidence within the prescribed time to properly defend your position. Failing to respond to a claim may result in a default judgment being filed against you. This may lead to garnished wages, sale of personal property, writ of seizure, property liens and/or sale of land/assets.
